A decisão proferida nesta terça-feira (3) pela 44ª Vara Cível de São Paulo, concede uma liminar à Associação Nacional de Jornais (ANJ), à Associação Brasileira de Emissoras de Rádio e Televisão (Abert) e à Associação Nacional de Editores de Revistas (Aner) em ação contra a Meta.

A liminar suspende novas regras comerciais da empresa e proíbe a coleta e o uso não autorizados de conteúdos dos veículos associados, inclusive para desenvolver e treinar sistemas de inteligência artificial.

O juiz Guilherme Madeira Dezem suspendeu parte dos Termos Comerciais da Meta, previstos para entrar em vigor em 20 de novembro deste ano e fixou multa diária de R$ 1 milhão em caso de descumprimento, limitada a R$ 100 milhões.

“As novas condições permitiriam à empresa usar programas automatizados para acessar, copiar, armazenar e analisar reportagens, fotografias, vídeos e outros conteúdos publicados nos sites dos veículos de comunicação”, informou a ANJ em comunicado. A autorização prévia dos veículos à Meta abrangeria materiais publicados fora de Facebook, Instagram, WhatsApp e Threads, inclusive obras protegidas por direitos autorais. “As regras também vinculavam a continuidade do uso das plataformas à aceitação dessas condições”, completou a associação.

A liminar obriga a Meta a manter as contas, páginas e ferramentas dos veículos associados em pleno funcionamento, sem bloqueios, restrições ou punições pela recusa das condições que entrariam em vigor a partir do dia 20 de novembro.

Em comunicado, as entidades afirmam que a decisão da 44ª Vara Cível de São Paulo representa uma vitória inicial das três associações na defesa da propriedade intelectual e da sustentabilidade do jornalismo profissional.

“A liminar é um sinal muito positivo de que há limites no abuso de poder econômico por parte de uma grande plataforma digital”, disse o presidente-executivo da ANJ, o jornalista Marcelo Rech, no comunicado. “A Justiça brasileira se mostra pioneira nesta proteção de direitos de milhares de veículos de comunicação representados pelas três associações de mídia”, acrescentou Rech.

No dia 28 de outubro um tribunal da Noruega proibiu a aplicação das novas regras da Meta. Dez grupos de mídia do país recorreram à Justiça para alegar que as novas condições, cuja entrada em vigor estava prevista para 20 de novembro, concederiam à Meta o direito de coletar artigos, fotografias e vídeos, inclusive aqueles protegidos por paywall, informou a AFP.

Na liminar proferia ontem (3), a Justiça brasileira apontou indícios de violação de direitos autorais e abuso contratual. A decisão ressalta a necessidade de autorização dos titulares para reprodução e exploração comercial de obras protegidas. A liminar vale até o julgamento definitivo da ação. Procurada pela reportagem do Valor, a Meta respondeu que não vai comentar a decisão.

As associações ANJ, Abert e Aner, bem como entidades da indústria musical e de direitos autorais, enviaram em dezembro de 2025, notificações às “big techs” que atuam no país buscando acordos sobre a autorização para uso de conteúdos protegidos por direitos autorais em ferramentas de inteligência artificial. As notificações foram enviadas à Meta bem como às subsidiárias das empresas Amazon Web Services (AWS), Apple, Google, Microsoft e OpenAI.T
