Reis, que é presidente do MDB no Rio de Janeiro, tentava se livrar da condenação para reaver seus direitos políticos e disputar as eleições de 2026. Ele foi condenado em 2022 pela Segunda Turma do STF a sete anos e dois meses de prisão, em regime inicial semiaberto.

Além da condenação, o dirigente ficou inelegível com base na Lei da Ficha Limpa, por ter sido condenado em segunda instância.

De acordo com a acusação, Reis teria determinado a construção do loteamento Vila Verde, localizado em área próxima à reserva biológica, entre 2005 e 2006. Na época, ele era deputado estadual e, posteriormente, foi prefeito de Duque de Caxias.

Os advogados entraram com um recurso para tentar rever a condenação pelo crime ambiental. A defesa alegou que alterações nas resoluções do Conselho Nacional do Meio Ambiente (Conama) desde a condenação de Reis modificaram os limites da área de conservação, diminuindo de dez para três quilômetros. De acordo com os advogados, a mudança faria com que não houvesse mais crime por parte do ex-prefeito.

O julgamento dos recursos em relação aos crimes ambientais começou em fevereiro de 2026, mas foi suspenso por um pedido de vista do ministro Luiz Fux. Na sessão desta quinta-feira, o ministro acolheu os argumentos da defesa e votou para absolver Reis do crime ambiental. O magistrado entendeu que a mudança fazia com que não houvesse mais crime.

Segundo Fux, a mudança modificou o alcance da proibição e, por isso, deveria ser aplicada retroativamente para beneficiar o ex-prefeito. Ele aderiu à divergência inaugurada pelo ministro André Mendonça, que também foi acompanhada por Kassio Nunes Marques.

Venceu, no entanto, o voto do relator dos recursos, ministro Flávio Dino. Ele foi acompanhado pelos ministros Alexandre de Moraes, Cristiano Zanin, Gilmar Mendes, Cármen Lúcia e Edson Fachin.

Cármen Lúcia destacou que, ainda que a margem da proibição tenha sido alterada, houve danos ambientais, o que seria suficiente para manter a condenação. Além disso, o empreendimento construído estava a 300 metros da área protegida. O argumento foi acompanhado por Fachin.

Ao Valor, Reis disse que irá recorrer da decisão da Corte.
