A audiência foi designada em ação protocolada pela Confederação Nacional do Comércio de Bens, Serviços e Turismo ( CNC ), que pedia liminar para postergar o calendário de implementação das mudanças.

Na decisão, Dino afirma que “a redução da jornada e a ampliação do repouso semanal não estão em negociação, em se tratando de emenda constitucional aprovada pelo Congresso Nacional”.

Na ação, a CNC questionou o cronograma de implementação progressiva das alterações promovidas pela Emenda Constitucional (EC) nº 141, de outubro de 2026, que tratou do fim da escala 6x1 prevendo efeitos de redução de jornada já em 2026, de 44 horas semanais para 42 e, em 2027, para 40. A CNC não trata no processo da redução, mas do prazo de implementação de dois meses, que exigiria negociações com sindicatos durante a temporada de fim de ano, quando as escalas já estavam dimensionadas segundo o regime anterior, conforme alegou na ação.

Dino cita, na decisão, a importância da regulação pela Constituição, mencionando episódios recentes de assédio eleitoral no ambiente de trabalho. “Na ausência de limites jurídicos efetivos, a desigualdade entre empregadores e empregados pode favorecer imposições unilaterais e constrangimentos incompatíveis com a liberdade individual”, afirma.

O ministro cita também que não cabe ao Supremo substituir as escolhas do Congresso Nacional por soluções que considere “mais adequadas ou convenientes”, cabendo apenas verificar a compatibilidade da emenda com os limites constitucionais. “A demonstração de que outra disciplina normativa seria possível ou de que determinado modelo produziria resultados mais convenientes não basta para caracterizar ofensa à Constituição”, diz.

Para Dino, os argumentos relativos ao regime de transição são plausíveis e merecem exame mais detido. Segundo o ministro, o prazo de dois meses para a redução de 2 horas semanais não é “inviável”, mas a Constituição reconhece as convenções e os acordos coletivos de trabalho e assegura a liberdade sindical, dando às categorias econômicas e profissionais espaço próprio de autorregulação.

Ainda Segundo Dino, a redução da jornada e a ampliação do repouso semanal não estão em negociação. O ministro deixa claro na decisão que será discutido na audiência pública apenas aspectos de implementação.

O ministro determinou a intimação, para participação, das confederações sindicais empresariais de âmbito nacional (representantes das categorias econômicas), centrais sindicais (entidades de representação geral dos trabalhadores), Advocacia Geral da União (AGU) e das advocacias do Senado Federal e da Câmara dos Deputados, além da Procuradoria Geral da República (PGR).
